This document describes how the TraceRoster Service operates, in plain language. It must be reviewed and approved by qualified legal counsel before being relied upon, and it does not constitute legal advice.
These Terms & Conditions ("Terms") govern your access to and use of TraceRoster's website, applications, and related services (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms.
1. Eligibility and accounts
You must be at least 16 years old and able to form a binding contract to use TraceRoster. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You agree to provide accurate information and keep it up to date.
2. Service overview
TraceRoster connects candidates and recruiting teams through AI-assisted search, messaging, shortlists, analytics, and workflow tools. Features available to you depend on your role, plan, and account status.
3. Candidate plans
Candidate plans are generally one-time purchases that activate profile discoverability and related features described at purchase. Candidate content you submit must be truthful, lawful, and owned by you or used with permission. TraceRoster may review, rank, or limit visibility of profiles to maintain platform quality and safety.
4. Recruiter subscriptions
Recruiter plans are billed on a recurring basis unless otherwise stated. Fees, seat limits, AI query allowances, overage rates, and included features are described on our pricing pages and in your account. Subscriptions renew automatically until canceled in accordance with your plan terms.
5. Acceptable use
You agree to use the Service lawfully and respectfully. In particular, you may not use it for unlawful, discriminatory, or harassing purposes; disrupt or attack the platform; misrepresent your identity, credentials, or employment history; circumvent access controls, billing, or security measures; or rely on AI outputs as the sole basis for hiring decisions without appropriate human review where required by law. 6. AI-generated content
The Service uses automated AI to help recruiters find candidates. When a resume is uploaded, it is processed automatically to extract structured information such as skills, a summary, and experience, which is used to power recruiter search. The Service may also generate summaries, recommendations, rankings, or draft messages. AI output may be incomplete or inaccurate and requires human review. You are responsible for reviewing AI output before relying on it in hiring or business decisions. TraceRoster does not guarantee that AI results will be error-free or fit for a particular purpose.
7. Your content and licenses
You retain ownership of content you submit. You grant TraceRoster a non-exclusive, worldwide license to host, process, display, and use that content solely to operate, improve, and secure the Service, including for AI search and profile features, subject to your visibility settings and applicable law. Candidates control their discoverability and can opt out of recruiter search, and a public profile is shared only through a revocable share link that the candidate controls.
8. Intellectual property
TraceRoster and its licensors own the Service, software, branding, and related intellectual property. Except for the limited rights expressly granted in these Terms, no rights are transferred to you.
9. Payments, taxes, and refunds
Payments are handled by a third-party payment processor, and you authorize us and that processor to charge applicable fees. Prices may change with notice where required. You are responsible for applicable taxes. Refund eligibility, if any, depends on the plan purchased and the circumstances of the request.
10. Suspension and termination
We may suspend or terminate access if you violate these Terms, create risk for other users, or fail to pay applicable fees. You may stop using the Service at any time. Candidates can permanently close their account from Settings; for security, closure requires your password and typing "DELETE" to confirm. On closure, your profile, resume, and uploaded files are permanently deleted, and you are permanently removed from recruiter search and recruiter shortlists. Past conversations remain visible to the other participant but are anonymized, with your identity replaced by "Deleted user." Provisions that by their nature should survive termination will remain in effect.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRACEROSTER DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRACEROSTER WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID TO TRACEROSTER IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR ONE HUNDRED U.S. DOLLARS ($100).
13. Changes to these Terms
We may modify these Terms from time to time. Material changes will be communicated through the Service or other reasonable means. Continued use after changes become effective constitutes acceptance of the updated Terms.
